This General Power of Attorney (the “Power of Attorney”) is made and effective [effective date],

AND: | [agent name], with an address of [agent address], hereinafter referred to as the “Agent”, collectively referred to as the “Parties”. |
APPOINTMENT OF AGENT
I, the Principal, with full decision-making capacity, hereby appoint the named Agent to act on my behalf, to make any and all decisions, and to control and manage my affairs without any limitation. The Agent shall have the authority to act on my behalf and in my name, place, and stead in any way which I myself could do, if I were personally present, with respect to the following matters as each of them is defined below:
POWERS OF AGENT
The Agent is granted the authority to act on behalf of the Principal in the following matters, with the option to delegate such authority to third parties, subject to the limitations and conditions outlined for each power:
Real Property Transactions: The Agent is authorized to conduct all forms of business related to the purchase, sale, management, and transfer of real estate property. This includes but is not limited to negotiating terms, signing agreements, and receiving proceeds. The Agent may delegate these powers to qualified real estate professionals, but such delegation does not absolve the Agent of their responsibility for the oversight of these transactions.
Personal Property Transactions: The Agent is empowered to handle all matters involving personal property, whether tangible or intangible. This includes the acquisition, lease, sale, management, and disposal of personal properties such as vehicles, stocks, bonds, and other assets. The Agent may delegate these powers to qualified individuals or entities, but the Agent remains accountable for the decisions made.
Banking Transactions: The Agent is authorized to perform any act required to access, manage, and conduct financial dealings with any type of banking, savings, or other financial institution. This encompasses the opening and closing of accounts, withdrawal and deposit of funds, and execution of all instruments of banking or financial services. The Agent may delegate specific banking tasks to financial professionals, but ultimate responsibility for financial decisions rests with the Agent.
Legal Matters: The Agent has the authority to represent the Principal's interests in all legal proceedings, including civil, criminal, administrative, or investigative matters. The Agent may engage in any legal action necessary to protect the Principal's personal and property rights. The Agent may consult with legal professionals but is responsible for decisions related to legal matters.
Tax Matters: The Agent is permitted to prepare, review, and file all types of tax forms, including returns, reports, declarations, and related documents. Additionally, the Agent may act on behalf of the Principal in all tax-related matters with appropriate authorities and may receive confidential information. The Agent may engage tax professionals as needed but remains accountable for tax-related decisions.
Benefits from Governmental Programs or Civil or Military Service: The Agent may prepare, submit, and receive applications and documents related to governmental and military service benefits on behalf of the Principal. The Agent may also interact with relevant entities in such matters. Delegation of specific tasks related to these benefits is allowed, but overall responsibility lies with the Agent.
Estate, Trust, and Other Beneficiary Transactions: The Agent is authorized to engage in all conduct related to the Principal's interests in estates and trusts, including decisions regarding claiming, relinquishing, disclaiming, ratifying, or contesting inheritance rights. The Agent may involve qualified professionals but remains responsible for beneficiary transactions.
Insurance and Annuity Transactions: The Agent may examine, secure, modify, or terminate any type of insurance or annuity contracts or proposals. The Agent can act on behalf of the Principal in all insurance matters, including payment of premiums and receipt of benefits. Delegation of specific tasks to insurance professionals is permitted, but ultimate accountability rests with the Agent.
Healthcare Billing and Payments: The Agent is authorized to negotiate and settle medical expenses with healthcare providers and insurers, as well as make payments for any medical, hospital, therapeutic, or other health-related expenses incurred by the Principal. The Agent may delegate specific healthcare billing and payment tasks to healthcare professionals but remains responsible for these financial matters.
Business Operating Transactions: The Agent may make decisions regarding the operation of any business that the Principal owns or has an interest in. This authority includes the hiring, payment, supervision, and discharge of employees and contractors. The Agent may delegate specific business-related tasks as necessary, but ultimate responsibility for business operations lies with the Agent.
DURABILITY
This Power of Attorney will continue to be effective if I become legally incapacitated or disabled, as defined by the laws of the jurisdiction in which it is executed. The authority granted to my Agent will persist throughout my lifetime unless I revoke it when I am capable of making my own decisions.
TERMINATION OF POWERS
In addition to the revocation provisions outlined elsewhere in this Power of Attorney, the authority granted to my Agent will cease to be effective under the following conditions:
Death of the Principal: The Agent's authority under this Power of Attorney shall automatically terminate upon the death of the Principal.
Bankruptcy of the Agent: If the Agent files for bankruptcy or becomes insolvent, their authority to act on behalf of the Principal in financial matters shall be terminated.
Resignation or Ineligibility of the Agent: If the Agent resigns, becomes ineligible, or is otherwise unable or unwilling to fulfill their responsibilities as Agent, their authority shall terminate, and a successor Agent, if designated, shall assume the responsibilities. If no successor Agent is named, the Principal or a court of competent jurisdiction shall appoint a new Agent.
Expiration of the Term: If a specific term is specified for the Power of Attorney, the authority granted herein shall automatically terminate upon the expiration of that term, unless renewed or extended by the Principal.
THIRD PARTIES
All persons, corporations, or entities that rely on the validity of this Power of Attorney will be indemnified and held harmless from any loss suffered as a result of their reliance on any actions taken by my Agent under this Power of Attorney.
REVOCATION
This Power of Attorney is revocable by me at any time when I am of sound mind and capable of making my own decisions. The revocation must be in writing and may require the same formalities as this Power of Attorney.
GOVERNING LAW
This Power of Attorney will be governed by the laws of the jurisdiction in which it is executed, as such laws are applied to agreements made and to be performed entirely within such jurisdiction. This document is to be interpreted and enforced in a manner that gives effect to the intent of the parties to the fullest extent possible under applicable law.
