Equipment Maintenance Agreement
[name of customer] (hereafter “Customer”) and [name of maintenance] (hereafter “Maintenance”) hereby agree to the following:
This contract refers exclusively to maintenance performed on the following product(s) (hereafter “Equipment”): [products, serial numbers, purchase dates].
This contract will go into effect on [date] and expire on [date 1] unless both parties agree to extend it another [length of time] term.
The Customer agrees to keep the Equipment on the property at [location] at all times unless approved by Maintenance. The Customer agrees to run [software/operating system], apply updates and patches at Maintenance’s recommendation, and keep the Equipment in [condition].
Maintenance agrees to prompt, friendly, and efficient service under the following parameters:
Phone support: Maintenance will be available by phone [days of the week] from [start time] to [end time].
Email support: Any emails sent to Maintenance at [email address] will be answered on [days of the week 1] between [start time 1] and [end time 1].
If phone and email support do not fix the issue, Maintenance will arrange to visit [location 1] and repair the Equipment within [amount of time] of the request, at Maintenance’s discretion. Maintenance will provide a window of time for arrival, and the Customer or their representative agrees to be present and available at that time.
The Customer agrees to allow remote access to Maintenance in order to receive proper care.
Maintenance agrees to provide all necessary tools, software, hardware and equipment required to maintain and repair the Equipment according to the agreed-upon standards and condition. The tools will be kept with [maintenance/the customer].
The Customer agrees not to attempt repairs or maintenance of the Equipment themselves or hire another company to perform repairs. Should that occur, Maintenance will be under no further obligation to repair or maintain the equipment, and may charge an hourly rate of [amount] for services rendered.
Maintenance will provide repair and maintenance to the Equipment strictly on the condition of manufacturer error, normal wear and tear, and acts of God. All other repair appointments will be billed at an hourly rate of [amount 1].
Maintenance and repair services do not include: [exclusions]
Any changes to this contract must be done so in writing and signed by both parties.
