About this template
What is this template?
This is a formal legal filing used within an ongoing arbitration to seek a court's ruling on a specific point of law. It is not a final award or a standard civil complaint, but a procedural bridge between arbitration and the judiciary. It contains specific sections for the agreed facts and the formulated legal question.
When should you use it?
Use this when a building contract dispute hinges on a complex interpretation of Indian law that the arbitrator cannot resolve without court guidance. Use a Statement of Claim instead if you are initiating the arbitration itself rather than seeking a mid-process legal opinion.
What's inside
| Clause | Name | What it does |
|---|---|---|
| Recitals | Recitals of Reference | Names the parties and identifies the specific building contract and arbitration agreement that gave rise to the legal dispute. |
| Paragraph 1 | Statement of Facts | Sets out the material facts found by the arbitrator or agreed by the parties which are necessary for the court to decide the question of law. |
| Paragraph 2 | The Question of Law | States the precise legal question, such as the interpretation of a specific contract clause, for the court's opinion. |
| Paragraph 3 | Arbitrator's Findings | Details the provisional findings made in the arbitration and explains why a judicial determination of law is required to proceed. |
