Community property agreement

This template outlines a Community Property Agreement between two spouses. It defines all property, present and future, as community property to be shared equally, while also allowing for specific exemptions. The agreement also specifies that upon the death of one spouse, all community property will vest in the surviving spouse in accordance with state and federal laws.

Community Property Agreement

 

[name of spouse 1] (hereafter “Spouse 1”) and [name of spouse 2] (hereafter “Spouse 2”) hereby agree to the following:

 

That all property owned by Spouse 1, including property that may be purchased, inherited, or received in the future, and including any property registered solely in [his/her] name or purchased with [his/her] money from [his/her] account, will be considered community property from this date forth, to be shared equally with Spouse 2.

That all property owned by Spouse 2, including property that may be purchased, inherited, or received in the future, and including any property registered solely in [his/her] name or purchased with [his/her] money from [his/her] account, will be considered community property from this date forth, to be shared equally with Spouse 1.

That the following property owned by Spouse 1 will be exempt from this agreement: [list of exempt property and assets that will not be shared property].

That the following property owned by Spouse 2 will be exempt from this agreement: [list of exempt property and assets that will not be shared property].

That, should Spouse 2 survive Spouse 1, all community property shall be vested to Spouse 2 on the occasion of Spouse 1’s death, in accordance with all state and federal laws.

That, should Spouse 1 survive Spouse 2, all community property shall be vested to Spouse 1 on the occasion of Spouse 2’s death, in accordance with all state and federal laws.

 

In witness to their agreement to the terms of this contract, the parties affix their signatures below:
