About this template

What is this template?

This is a statutory filing used by the Trade Marks Registry in India to regulate the split of trade mark rights across different geographical territories. It is not a transfer deed itself but a request for the Registrar's prior approval of a proposed transfer. The document requires a 'Statement of Case' and specific details regarding the class of goods and services affected.

When should you use it?

Use this form when you intend to divide ownership of a trade mark so that different owners hold rights in different parts of India. Use Form TM-24 instead for a standard assignment or transmission that does not involve this territorial division of exclusive rights.

Who it's for

  • a trade mark proprietor in India proposing an assignment resulting in exclusive rights for different persons in different regions
  • a person claiming transmission of an Indian trade mark from a predecessor in title for specific goods or services
