An agreement between a builder/developer and a broker (real estate agent) in India, appointing the broker to sell residential flats in a project under construction, on a commission basis. It covers the broker's appointment and the price and terms (set out in an annexure), the commission rate, the builder's warranties as to clear and marketable title and quality of construction, and the fixed period of the broker's authority to sell. Note: for projects and agents covered by the Real Estate (Regulation and Development) Act, 2016 (RERA), the project and the broker must be RERA-registered.
