A cost-plus building construction contract under which a contractor constructs a building on the owner's plot according to an architect's sanctioned plans, in India, for the actual cost of the works plus an agreed percentage as profit. It covers the required standard and manner of construction, the completion date and daily liquidated damages for delay, the architect's powers (to extend time, take over the works on the contractor's default, remove incompetent workmen or unfit materials, order rectification, and direct additions or alterations), the contractor's liability for damage and for legal compliance, restrictions on sub-contracting and assignment, the remuneration and monthly payment schedule, and the architect's final say on certification and release of payment.
