CATERING CONTRACT
This Catering Contract (the "Contract") is entered into on [date], the ("Effective Date"),

The Client has hired the Caterer to provide food and beverages, as well as related services, for an upcoming event (the “Event”).

Food Menu
The Parties have agreed to the following menu. However, the Caterer reserves the right to make small changes to the menu if necessary ingredients are unavailable due to reasons out of their control. (Write or create a list detailing the proposed menu – see example below).

The caterer must have access to the venue three hours before the event's start time and two hours after the event's end time for clean up. The client will make all necessary arrangements to obtain this access at the client's expense.
Related Costs
The Client is responsible for all costs and deposits related to the use of the venue, including but not limited to rental fees, security deposits, and any permits or authorizations required by the catering company or local authorities for the provision of catering services at the venue.
The specific permissions and authorizations may include, but are not limited to, health and safety permits, alcohol service licenses, and any other regulatory approvals necessary for the lawful operation of the catering services at the chosen venue.
Terms of Payment
Client will pay Caterer [charge per guest] per person attending the event in exchange for Caterer's services as specified in this Catering Contract. The total cost for catering services shall be based on the Guest Count provided by the Client to Caterer one week prior to the Event. This Guest Count will serve as the minimum charge for the event.
The Estimated Total Cost of the event is [estimated total] (the "Estimated Total Cost").
The Caterer will be paid a deposit of [deposit amount] on the date of signing, and the remaining balance one week before the event. The exact amount due will be determined and provided in writing by the Client to the Caterer one week prior to the Event, along with a final Guest Count.
Disruption and Delays
If there is a delay caused by bad weather, fire, flood, strike, or other labor dispute, acts of God, or acts of government officials or agencies, the Caterer is not responsible for that period of time, which may be longer than the time lost due to one or more of these causes.
Insurance and Indemnification
The caterer will have or will get general liability insurance for the caterer's services at the event. However, the client will pay for any damage, theft, or loss of the caterer's property that happens at the event and is caused by any of the client's guests.
Cancelation
The Client must notify the Caterer of their intention to cancel the event in writing. Cancellation notices must be received no later than 60 days before the scheduled event date. In the event of cancellation, the Client shall be responsible for paying a cancellation fee of [cancelation charge] on top of the estimated total cost.
The deposit that the Client paid will go towards the cancellation fees that are owed. Any remaining balance will be due once the cancellation notice is received.
Legal Compliance
The caterer will follow all local health department rules and regulations regarding food preparation and service.
Assignment
Neither party may assign this Catering Contract without the written consent of the other party, except as expressly provided for in a separate section of this Catering Contract.
Limitation of Remedies
If the Caterer is unable to fulfill their obligations under this contract due to circumstances beyond its control, the Caterer may find and retain a replacement catering company at no additional cost to the client, or the Caterer may refund the Client's money in full. Under these circumstances, the Caterer will not be liable for any additional damages or compensation.
Notice
Any required notice or communication for this Catering Contract must be written, and delivered either in person, or by overnight mail, registered mail, or confirmed e-mail. It must be addressed to the Parties specified in the Catering Contract.
Dispute Resolution
In the event of any disputes arising from this Catering Contract or the Event, the Parties agree to engage in a good faith effort to resolve the dispute through negotiation and mediation. Should the dispute persist after negotiation and mediation, either Party may initiate arbitration proceedings by providing written notice to the other Party.
The arbitration shall be conducted in accordance with the rules and procedures of a recognized arbitration organization mutually agreed upon by the Parties or, in the absence of mutual agreement, as determined by the prevailing party in the dispute.
In the case of arbitration, each Party shall bear its own costs, including legal fees, unless otherwise determined by the arbitrator.
Before initiating any formal dispute resolution process, the Parties shall make reasonable efforts to resolve the matter amicably by first providing written notice to the other Party outlining the nature of the dispute and proposing potential solutions.
Authority
Both Parties agree that they are authorized to fulfill their obligations under this Catering Contract, and that the person who signs this Catering Contract is authorized to bind it.
Entire Contract
This Catering Contract is the only agreement between the Client and Caterer regarding everything mentioned here, and can only be changed if both parties agree in writing.
