LODGER AGREEMENT
This Lodger Agreement (hereinafter referred to as the "Agreement") is made and effective [START DATE] (the “Effective Date”),
BY AND BETWEEN: | [LANDLORDS FULL NAME], with an address of [LANDLORDS ADDRESS], hereinafter referred to as the “Landlord”. |
AND: | [LODGERS FULL NAME], hereinafter referred to as the “Lodger”, collectively referred to as the “Parties”. |
PROPERTY
The address for the property is the same as mentioned above for the landlord. This property is the primary residence of the landlord, and the lodger shall reside in it as a licensee and not as a tenant.
ROOMS AND SHARED AREAS
The lodger will have exclusive access to the following rooms: [LIST LODGERS ROOMS]. Apart from these rooms, the lodger will have shared access to certain areas of the property: [LIST SHARED AREAS]. These shared areas are meant for communal use, and both the landlord and lodger should ensure their mutual comfort and respect each other's rights while using them.
TERM OF AGREEMENT
This agreement starts on [START DATE]. It is a flexible, rolling arrangement and will continue until either party decides to end it as mentioned in the termination section. Both parties will review this agreement periodically.
RENT
The lodger has to pay [RENTAL AMOUNT WEEKLY/MONTHLY] on a weekly/monthly basis (choose one). This payment is expected weekly/monthly, in advance, on the first day of the relevant payment period. Delay in payment might incur penalties as agreed upon by both parties.
DEPOSIT
Upon commencement, the lodger should provide a deposit amounting to [DEPOSIT AMOUNT]. This deposit will act as security against any damages to the property or unpaid rent. When the lodger decides to leave, this deposit will be returned after deducting any amounts due to damages or unpaid dues.
OBLIGATIONS OF THE LODGER
The Lodger is responsible for maintaining the cleanliness of their exclusive rooms and contributing to the cleanliness of the shared areas. They should not make any structural or decorative changes to the room without written consent from the landlord. Engaging in illegal activities within the premises is strictly prohibited. The lodger should also ensure that they do not disturb the landlord or neighbors, especially between 11 pm to 7 am.
OBLIGATIONS OF THE LANDLORD
The landlord is responsible for making sure that the entire property, including the lodger's rooms and shared areas, are in a habitable condition. Regular maintenance and repairs should be undertaken by the landlord. The landlord should also ensure that they respect the lodger's privacy and not enter their rooms without prior notice, except in emergencies.
TERMINATION
Both parties have the right to end this agreement by giving a one-month written notice. However, if the lodger breaks any terms of this agreement, the landlord has the right to terminate the agreement immediately and request the lodger to vacate.
GENERAL PROVISIONS
This written document captures the entire understanding between the landlord and the lodger. Any changes or modifications should be in writing and should have the acknowledgment of both parties. If any part of this agreement becomes unenforceable due to any reason, the rest of the agreement remains in effect.
GOVERNING LAW
The laws of the region where the property is located govern this agreement.
