A building construction contract on a fee-plus-cost basis, under which a contractor constructs a house on the owner's plot according to an architect's sanctioned plans in India, being reimbursed the cost of labour and materials plus a fee. It covers the standard and manner of construction to the architect's satisfaction, commencement and completion with liquidated damages for delay (capped at 2%), stage-wise payments certified by the architect with 5% retention money and a 12-month defects-liability period, free access to site, the contractor's indemnity for injury and damage, the owner's extensive rights on the contractor's default or abandonment (termination, taking over materials and plant, and completion by others, with the architect's final certification of accounts), appointment of a site engineer, inspection and rectification of defects, and dispute resolution by arbitration.
