EMPLOYMENT AGREEMENT (ASSISTANT)
This agreement is made on this ______ day of ________, 20, between Shri ____________________, S/o ____________________, resident of ____________________________________ (hereinafter called the "Employer") of the One Part, and Shri ____________________, S/o ____________________, resident of ____________________________________ (hereinafter called the "Workman") of the Other Part.
It is hereby agreed as follows:
In consideration of the good and faithful service to be rendered, the duties to be performed, and the terms and conditions to be observed and fulfilled by the workman, the employer hereby appoints the workman as his assistant to serve under him in his business or trade of export of goods, on the terms and conditions set out below.
The workman will serve the employer as an assistant for a period of ______ months (or years) from the ______ day of ____________, and will do, perform and execute, with all due punctuality and diligence and to the best of his intelligence, skill and ability, all such work as the employer may require of him in that capacity. At all times he will conduct himself honestly, faithfully and properly in the course of such service towards the employer, his customers and his fellow workmen.
During the period of this agreement, the workman shall not, without the express written consent of the employer, serve with any person, company or firm carrying on a similar trade or business, nor himself become interested in any trade or business akin to or similar to that carried on by the employer within a radius of five miles from the employer's trade premises.
The employer will pay the workman wages of Rs. ____________ per week (or per month), payable on the Saturday of every week (or on the last day of every month), for so long as the workman performs his duties faithfully, honestly and diligently and fulfils the terms of this agreement.
If the workman remains absent from the service of the employer without notice or leave, or is guilty of misconduct, or commits any breach of this agreement or any act of indiscipline, the employer may summarily dismiss him, without prejudice to the employer's other rights and remedies against him. In such an event the workman shall be entitled to the wages earned by him up to the date of dismissal, subject to any lawful deductions.
If the workman is at any time incapacitated by illness, accident or any other unavoidable cause from efficiently performing his duties under this agreement, his wages shall not be payable during the period of such incapacity, except to the extent provided under the Employees' Compensation Act, 1923 (formerly the Workmen's Compensation Act) or any other law for the time being in force.
Either party may terminate this agreement at any time by giving the other ______ days' prior written notice for that purpose.
