About this template

What is this template?

This is a sworn statement of facts used to support a miscellaneous application in Indian civil courts. It specifically addresses the reasons for non-appearance, such as a counsel's illness, and is not a substantive pleading on the merits of the underlying appeal.

When should you use it?

Use this when a Civil Miscellaneous Petition or Appeal has been dismissed for default and you need to provide evidence for its restoration. Use a Petition for Restoration of Suit instead if you are filing the primary motion rather than the supporting evidence.

Who it's for

  • an applicant in a New Delhi civil matter seeking to restore a suit dismissed for default
  • a party whose counsel was unable to attend court due to illness or contingency
  • a litigant invoking the inherent powers of the court under Section 151 CPC
